The lack of regulations on the voluntary resignation of the private employment relationship

This essay explores one of the most commonly used institutions in Ecuadorian society for terminating employment relationships, a nonexistent legal system: voluntary resignation. Although most workers believe this institution exists, it is not legally established among the grounds for termination of individual employment contracts in the Labor Code. Therefore, it is neither legal nor appropriate to use it, especially when it does not generate rights for the worker or prevent them from exercising other actions against their employer in the future, that is, after having expressly or tacitly resigned. This institution is analyzed in Spain and in various Latin American countries, allowing for a comparative study of it. Voluntary resignation is related to the principle of non-waivability of rights, different situations that may arise are analyzed, and a comparative analysis is made between eviction and resignation, taking into account their legal nature and social, labor, and economic consequences.
