Copyright Policy
In the Republic of Cuba, the paramount interest imposed by the social need for the widest dissemination of science, technology, education, and culture in general constitutes a priority in the legislative order. On December 28, 1977, Law No. 14 on "Copyright" was enacted. Likewise, in 2023, Law 162/2023 "On Social Communication" was enacted, whose Article 32 refers to the aforementioned right. Both legislations provide proper protection for Copyright in the Republic of Cuba, in harmony with the interests, objectives, and principles of the Socialist Revolution.
Copyright, as legislated, refers to scientific, artistic, literary, and educational works of an original nature, which have been or can be made publicly known by any lawful means, regardless of their forms of expression, content, value, or purpose. All individuals designated as authors must be qualified for such authorship, and all who qualify as such must be listed as authors. Each author must have participated sufficiently in the work to be publicly responsible for appropriate portions of its content. One or more authors must take responsibility for the overall integrity of the work, from its inception until it is published.
Authorship accreditation is based on:
1. Substantial contributions to the conception and design, or the acquisition of data, or the analysis and interpretation of data.
2. Drafting the article or critically revising its important intellectual content.
3. Final approval of the version to be published.
Conditions 1, 2, and 3 must all be met to be considered an author. Obtaining funding, collecting data, or general supervision of the research group, by themselves, do not justify authorship.
The order of precedence in the list should be determined by joint decision of the authors, who must be prepared to explain the order in which they are placed in the manuscript. This will correspond to substantial contributions in the conception or design of the work; the acquisition, analysis, or interpretation of data; the writing of the work or its substantial revision.
Opuntia Brava in this process reaches a consensus on the role of the corresponding author, usually the one who ensures that the other authors receive and agree with the final version of the manuscript to be submitted, as well as all subsequent correspondence with editors and reviewers.
The authors are responsible for adapting the article to the journal's standards, as well as ensuring that the data are preserved according to best practices in the field so that they can be retrieved for re-analysis; confirming that the presented data accurately reflect the original; and anticipating and minimizing obstacles for the sharing of data and materials described in the work in accordance with all the authors, among other duties.
The authors may use the material from their article in other works or texts published by them, provided that they cite the journal Opuntia Brava as the original source.
