Abstract

Mediation in Ecuador, whose agreements have the effect of an enforceable judgment, requires free and informed consent. This article analyzes the applicability of different Neuro-Linguistic Programming (NLP) techniques as a tool for mediators to identify volitional and cognitive impairments that vitiate such consent. Using an exploratory and analytical qualitative methodology, the legal framework is examined and NLP theory and techniques are contrasted with the study of hypothetical cases. It is concluded that specific techniques such as calibration and the language metamodel, among others, used ethically, allow the mediator to detect indicators of coercion or confusion. Their correct application does not seek to diagnose, but rather to protect the validity of the process, transforming the mediator into an active guarantor of the autonomy of will and ensuring that agreements are sustainable and legally robust.
